BUSINESS AND OPERATIONS: DATA PROCESSING EQUIPMENT [LAW]
1. Definitions
“Data
processing,” as used in this policy, means information technology equipment and
related services designed for the automated storage, manipulation, and
retrieval of data by electronic or mechanical means. The term includes:
A. Central
processing units, front-end processing units, miniprocessors, microprocessors,
and related peripheral equipment such as data storage devices, document
scanners, data entry equipment, terminal controllers, data terminal equipment,
computer based word processing systems other than memory typewriters, and
equipment and systems for computer networks;
B. All related
services, including feasibility studies, systems design, software development,
and time-sharing services, provided by state employees or others; and
C. The
programs and routines used to employ and control the capabilities of data
processing hardware, including operating systems, compilers, assemblers,
utilities, library routines, maintenance routines, applications, and computer
networking programs.
2. Transfers of Equipment to Students
The school may transfer to a student enrolled in the school:
A. Any
data processing equipment donated to the school, including equipment donated
by:
(1) A
private donor; or
(2) A
state eleemosynary institution or state agency;
B. Any
equipment purchased by the school, to the extent consistent with this policy; [See below, Expenditure of Funds, paragraph
(5)]; and
C. Any
surplus or salvage equipment owned by the school.
3. Donations
of Data Processing Equipment
The school may accept donations of data processing
equipment for transfers authorized by this policy and any gifts, grants, or
donations of money or services to purchase, refurbish, or repair data
processing equipment.
4. Eligibility for Receipt of Equipment
A
student is eligible to receive data processing equipment only if the school
determines that the student does not otherwise have home access to data
processing equipment. In transferring
equipment, the school shall give priority to students who are educationally
disadvantaged.
5. Expenditure of Public Funds
The school may spend
public funds to:
A. Purchase,
refurbish, or repair any data processing equipment transferred to a student;
and
B. Store, transport, or transfer data processing equipment.
6. Return of Equipment
Unless
the school determines that the equipment has no marketable value at the time of
return, a student who receives data processing equipment from the school shall
return the equipment to the school not later than the earliest of:
A. Five (5) years after the date the student receives the
equipment;
B. The date the student graduates;
C. The date the student transfers to
another charter school or school district; or
D. The date the student withdraws from the school.
