BUSINESS
AND OPERATIONS: PROCUREMENT [LAW]
1. Applicability of Certain Laws
Unless
the school has amended its charter to adopt alternative procedures for
purchasing and contracting, the school is subject to:
A. Chapter 2252
of the Texas Government Code (relating to awards of contracts to nonresident
bidders;
B. Subchapter
B, Chapter 271, of the Local Government Code (relating to competitive bidding
on public works contracts);
C. Subchapter A,
Chapter 2254 of the Texas Government Code (relating to procurement of
professional services);
D. Sections
2256.009-.016 of the Texas Government Code (relating to investment of public
funds).
2. Procurement Options
If the
commissioner of education approves an amendment to the open-enrollment charter
describing the manner in which the charter school will comply with each term of
the program, the school may voluntarily participate in any of the following
state programs available to school districts:
A. A program
under Local Government Code, Chapter 271, subchapter D, requiring the State
Purchasing and General Services Commission to perform purchasing services for
school districts;
B. A
program under Local Government Code, Chapter 271, subchapter F, permitting a
school district to participate in a cooperative purchasing program with a
school district, local government, or local cooperative organization;
C. To
the extent permitted by federal law, a program under Local Government Code,
Chapter 271, subchapter G, permitting a school district to purchase goods or
services available under federal supply schedules of the United States General
Services Administration;
D. A program
under Local Government Code, Chapter 271, subchapter E, permitting a school
district to enter into an intercept agreement with the Texas Bond Review Board
and the Comptroller of Public Accounts to increase its credit rating;
E. A
program under Tex. Educ. Code § 29.903, permitting a school district to offer
an electronic course to students enrolled in the district, or to students
enrolled in another district, as provided by an agreement between the
districts; and
F. A program
under Tex. Educ. Code § 29.1531, permitting a school district to offer, on a
tuition basis, or use school district funds to provide, an additional half-day
of pre-kindergarten classes to children eligible for classes under Tex. Educ.
Code § 29.153, or half-day and full-day pre-kindergarten classes to
children not eligible for classes under Tex. Educ. Code § 29.153.
