REQUIREMENTS OF CIVIL ACTION 5281, SECTION A
The Equal Educational Opportunity Unit in the TEA Department of Accountability and School Accreditation reviews all student transfers between school districts/charters to determine whether: "the cumulative effect, in either the sending or receiving school or school district, will be to reduce or impede desegregation, or to reinforce, renew, or encourage the continuation of acts and practices resulting in discriminatory treatment of students on the grounds of race, color, or national origin."

Charters, like independent school districts, must report transfer students. The Transfer Form (ACC-041BR00) was due to the Agency by May 10, 2000. A few charters have complied with the court order. Many charters returned the form stating either they had "NO TRANSFERS" or they did not respond to the court order requirement at all.

All students attending charters are considered to be transfers and must be reported to the Agency. Failure to return the Transfer Form (ACC-041BR00) will result in incomplete transfer records for your charter and will place the charter in violation of the federal court order. The EEO office will release a July 1, 2000 letter to all districts/charters with the status of compliance. If the Transfer Form (ACC-041BR00) has not been submitted to the Agency in a timely manner to complete a data analysis, the charter will be in a non-compliance status.

The TEA EEO unit is presently making calls to all charters to assist them in completing the Transfer Form (ACC-041BR00). Please contact Dr. Don Enos or Dr. Sylvia Gonzales for assistance at 512-463-9290.
